Terms and Conditions

1. General
a. Ranger Events may only be booked online.  A Booking is made when you accept the terms and conditions, complete the personal details online and make the appropriate payment (the Fee).  Completion of these steps constitutes a binding contract between us on these terms and conditions.
b. If Bookings are made by you on behalf of other individuals, you confirm that you have the authority to make the booking on behalf of these individuals. By booking on line you accept responsibility for ensuring that all the members of your group comply with these terms and conditions.
c. We reserve the right not to fulfil or accept a Booking for any reasonable reason. All bookings are subject to availability of staff and associated resources.
d. Bookings are non-transferrable and non-refundable unless the event is cancelled by The Peak District National Park Authority.
e. We reserve the right to alter or cancel an activity or event if we deem it is not safe to proceed. This is most likely in the event of extreme weather conditions including high winds, temperature extremes and high rainfall. We will notify you at the earliest opportunity on the contact details that you have provided during the booking process.
f. We reserve the right to cancel an event where we have specified that a minimum number of attendees are required for the event to proceed and this minimum number is not reached.
g. We accept no responsibility for personal property or equipment that may be lost or damaged during the event or activity.

2. Your Responsibilities
a. You confirm that you are 18 or above. Participants under the age of 18 must be accompanied by an adult aged 18 or above.
b. We will use our skill and judgement in delivering an event. However, you accept that taking part in any activity carries its own risks and you are participating at your own risk, subject to us complying with our responsibilities.
c. You will comply with any reasonable request made by a Ranger (and immediately with all instructions given by a Ranger in the case of any health and safety matters) whilst attending an event. Anyone failing to abide by these instructions may be asked to leave the activity if, in the opinion of the event leader(s), their actions could jeopardise anyone in the group.
d. If anyone leaves an event before the finish, either by agreement or having been asked to by the Event Leader, the Event Leader or Leaders duty of care will cease at that point.
e. The description of an event is illustrative only. Although we will try to ensure that the features and highlights of any event are included, we are not responsible for the impact on the event of adverse weather conditions or other circumstances outside of our control.
f. Participants must wear suitable outdoor clothing & footwear. We reserve the right to exclude participants if they are deemed by Event Leaders not to be adequately prepared and equipped for the event and weather conditions. Please check the website event listing which will state if specific items and equipment are advised or essential, particularly in relation to footwear and clothing.
g. It is your responsibility to ensure that you have enough food and drink for the type and duration of the activity except where it has been specified that we will provide meals.
h. Food allergy information, where relevant and requested in the event description, must be made at the time of booking and can only be accommodated on our experiences when booked at least 7 days in advance.
i. By attending the event you accept that you are mentally and physically capable of the event or activity. If you are in any doubt please declare, to the Event Leader (in confidence), any relevant medical information that may affect your ability to safely undertake the activity.
j. The activity listing on our website will state if dogs are allowed on the event. Well behaved dogs on leads and guide dogs are generally welcome. However, if a dog becomes a risk to participants, the owner may be asked to walk behind the group or leave the activity.

3. Our Responsibilities
a. We will ensure that the event is safe, legal and appropriate for you. We will carry out the appropriate health and safety checks of the event.
b. We will ensure that the requirements of and the level of difficulty of our event are properly described on our website.
c. Your safety is our first priority. Event Leaders may ask you not to participate in an event if they are of the opinion that your safety is at risk due to inappropriate clothing or equipment or any other consideration. We will not be responsible for your failure to start or complete the event due to your lack of fitness, illness, or injury. No refund of the fee will be paid in these circumstances.
d. We will not be responsible for any delay or changes to the event (including cancellation) due to weather conditions on the day of the event, war, strikes or anything outside of our reasonable control. No refund of the fee will be paid in these circumstances. If we cancel the event or your booking because we have insufficient staff to carry out the event or for any other reason within our reasonable control, we will notify you as soon as practicable and refund your booking fee in full.

4. Payment and Prices
a. You will pay the fee at the time of booking and in return we will arrange and fulfil your booking.
b. The fee is not refundable or transferrable if you cancel your booking. The only exception to this is the English National Park Events - A Ranger's Journey and White Peak Trails By eBike. Please see items (d)i, ii, iii, iv.

5. Third Party Services
a. Where third party services are involved, additional terms and conditions may apply. If this is the case, these will be added to the event description.
b. Where third party services are involved minimum attendance numbers may be set. If the minimum number of attendees is not achieved we reserve the right to cancel the event and refund your booking in full or, at your request, transfer you to another event.

6. Liability
a. We only accept responsibility for death, personal injury or direct loss suffered by you which you can show was caused by our negligence.
b. We will not be liable for any alleged loss or damage resulting from:
i. Your acts or omissions (including any persons in your group);
ii. The acts or omission of any third party not connected to us;
iii. An event which we could not have predicted or prevented, despite taking reasonable care;
iv. Indirect or consequential loss.
c. We will not be liable to you if we are unable to fulfil a booking because of circumstances outside of our reasonable control.

7. General
a. These terms and conditions constitute the entire agreement between us, superseding any previous agreement or understanding and may not be varied except in writing between us. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
b. No failure or delay by either of us in exercising any rights under these terms and conditions shall be treated or considered to be a waiver of those rights and no waiver of a breach shall be considered to be a waiver of a subsequent breach of the same (or any other) term or condition.
c. Except where expressly permitted under the Data Protection Act 1998, we will only use Your personal details in connection with your booking, unless you agree otherwise. We will keep your personal details secure in accordance with Our obligations under the Date Protection Act 1998.
d. If any of these terms and conditions is held by court to be invalid or unenforceable, the validity of any other of these terms and conditions shall not be affected.
e. Except as expressly provided, nothing in these terms and conditions confers on any third party any benefit or right to enforce any of these terms and conditions pursuant to the Contracts (Rights of Third Parties) Act 1999.
f. These terms and conditions are governed by English law.
