Terms and Conditions

 1. Terms and Conditions
a. A Duke of Edinburgh Residential Course (the Residential Course) may only be booked online. A Booking is made when you accept the terms and conditions, complete the personal details on line and make the appropriate payment (the Fee).  Completion of these steps constitutes a binding contract between us on these terms and conditions.
b. If Bookings are made by You on behalf of an individual under 18 You confirm You have the authority to make the booking on behalf of that individual. By booking on line You accept responsibility for ensuring that that individual complies with these terms and conditions.
c. We reserve the right not to fulfil or accept a Booking for any reasonable reason. All bookings are subject to availability of staff and associated resources.
d. Bookings are non-transferrable.

2. Your responsibilities
a. You confirm that You are 18 or above. Participants under the age of 18 must be accompanied by an adult aged 18 or above.
b. We will use our skill and judgement in delivering a Residential Course. However, You accept that taking part in any activity carries its own risks and You are participating at Your own risk, subject to Us complying with Our responsibilities.
c. You will comply with any reasonable request made by Authority staff/Volunteer Supervisor (and immediately with all instructions given by Authority staff/Volunteer Supervisor in the case of any health and safety matters) whilst attending a Residential Course.
d. The description of a Residential Course is illustrative only. Although We will try to ensure that the features and highlights of any Residential Course are included, We are not responsible for the impact on the Residential Course of adverse weather conditions or other circumstances outside of Our control.
e. You agree that any photographs taken by Authority staff/Volunteer Supervisor during the Residential Course may be used for Authority publicity purposes.
f. You will comply with the Terms of use of the residential centres.

3. Our Responsibilities
a. We will ensure that the Residential Course is safe and legal, and appropriate for You. We will carry out the appropriate health and safety checks of the Residential Course.
b. Your safety is Our first priority. Authority staff/the Volunteer Supervisor may ask You not to participate in an activity or the Residential Course if they are of the opinion that Your safety is at risk due to inappropriate clothing or equipment or any other consideration.
c. We will not be responsible for Your failure to attend or complete the Residential Course due to Your lack of fitness, illness, or injury. No refund of the Fee will be paid in these circumstances.
d. We will not be responsible for any delay or changes to the Residential Course (including cancelation) due to weather conditions on the day of the event, war, strikes or anything outside of Our reasonable control. No refund of the Fee will be paid in these circumstances. If We cancel the Residential Course or Your Booking because We have insufficient staff to carry out the Residential Course or for any other reason within our reasonable control, We will notify You as soon as practicable and refund Your Booking Fee in full.
e. We reserve the right to terminate any Booking if You fail to comply with these terms and conditions.

4. Payment and Prices
a. In return for our arranging and fulfilling Your Booking You will pay the Fee at the time of Booking.
b.  In the case of cancellation by You, up to one month before the start date of the Residential Course we will refund the amount paid minus £50 administration costs. For cancellations within a month of the start date of the Residential Course, the full amount will be retained.

5. Liability
a. We only accept responsibility for death, personal injury or direct loss suffered by You which You can show was caused by Our negligence.
b. We will not be liable for any alleged loss or damage resulting from:
i. Your acts or omissions;
ii. The acts or omission of any third party not connected to Us;
iii. An event which We could not have predicted or prevented, despite taking reasonable care;
iv. Indirect or consequential loss.
c. We will not be liable to You if We are unable to fulfil a Booking because of circumstances outside of Our reasonable control.
d. Except for death and personal injury, where there is no limit, Our total liability to You under the contract with You shall be limited to the total cost of Your Fee.

6. Online Booking
a. All bookings made online are, in addition to statutes regulating the sales of goods and services, subject to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the Regulations).
b. Right to cancel: Generally, as the Booking is for services related to leisure activities for a specific date, you do not have a right to cancel and receive a refund under Regulation 28.

7. General
a. These terms and conditions constitute the entire agreement between us, superseding any previous agreement or understanding and may not be varied except in writing between us. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
b. No failure or delay by either of us in exercising any rights under these terms and conditions shall be treated or considered to be a waiver of those rights and no waiver of a breach shall be considered to be a waiver of a subsequent breach of the same (or any other) term or condition.
c. Except where expressly permitted under the Data Protection Act 1998, we will only use Your personal details in connection with Your booking, unless You agree otherwise. We will keep Your personal details secure in accordance with Our obligations under the Date Protection Act 1998.
d. If any of these terms and conditions is held by court to be invalid or unenforceable, the validity of any other of these terms and conditions shall not be affected.
e. Except as expressly provided, nothing in these terms and conditions confers on any third party any benefit or right to enforce any of these terms and conditions pursuant to the Contracts (Rights of Third Parties) Act 1999.
